The attorney in this role will be supporting Citi’s Mortgage Servicing business in two (2) primary areas: (i) the Oversight Team that monitors/manages the performance of Cenlar, FSB, the Subservicer responsible for servicing Citi’s mortgage (Conventional, FHA/VA, Heloc, Frhel) portfolio; and (ii) the Residual Operations team that handles Customer/Investor/Third Party inquiries and complaints on legacy loans and, under some circumstances,  on loans serviced by Cenlar.

This attorney will work directly with a wide array of Citi departments (e.g., Oversight, Relationship Management, Compliance, Risk, Operations and others) to analyze Cenlar’s performance to assess compliance with applicable laws and with existing contractual obligations.  This attorney will provide direction under the Subservicing Agreement related to Cenlar’s performance, changes to policies and procedures, and remediation of errors.  This attorney will draft, negotiate and review contract amendments to govern changes in the Cenlar contractual relationship.  Lastly, this attorney will review changes to applicable laws (e.g., RESPA, TILA) in order to advise the Oversight team of the implications to Cenlar’s business and the corresponding changes needed to Citi’s oversight/audits/examinations of Cenlar’s performance.

Citi’s Residual Operations team reviews and resolves loan-level issues with Customers and servicing issues with Investors (e.g., FannieMae, Private Investors) on legacy loans that were previously serviced by Citi. In addition, Cenlar can request Citi’s instructions on how to handle a wide variety of transactional issues with both Customers and Investors. These issues require Legal analysis and recommendations for practical solutions.

This attorney will report to the Managing Director of the Consumer Servicing and Operations Team, and will be part of a that team, working directly with business management and functional partners in the support of Cenlar Oversight and Citi Residual Operations.

Qualifications

Qualified candidates will have significant experience in: (i) federal consumer credit laws and regulations including TILA, RESPA, FCRA, FDCPA, EFTA and UDAAP; (ii) state consumer credit and mortgage laws including payoff, reconveyance, title issues, collections, default and foreclosure; and (iii) contract drafting and negotiation.

Qualified candidates will have strong organizations skills to manage a large volume and variety of projects, contracts and transactional issues. Integral to this position is the ability to advise senior management of legal/servicing/operational risks and helping to devise practical solutions.

Candidate must have:

  • A Juris Doctor degree
  • A license in good standing to practice law in at least one state
  • A preference of 7 years, but a minimum of 5 years of relevant legal experience in financial services
  • Excellent interpersonal and communication skills
